General Terms and Conditions of Sale and Service

These General Terms and Conditions of Sale and Service (hereinafter the “Terms”) govern sales made through the Kippway online store.

By placing an order on our store, the customer acknowledges having read and accepted these Terms.

Kippway is an online store specializing in the sale of clothing.

2. Products

The products offered for sale are those presented on the Kippway store, subject to availability.

We make every effort to present the products and their characteristics as accurately as possible.

Photographs, illustrations, and representations of the products are provided for presentation purposes. Slight differences in color or appearance may occur, particularly depending on the screen used by the customer.

The essential characteristics of the product are indicated on its product page before the order is confirmed.

3. Prices

Product prices are displayed in euros.

The applicable price is the price displayed on the store at the time the customer places their order.

Any applicable delivery fees are indicated to the customer before the final confirmation of the order.

Kippway reserves the right to modify its prices at any time. However, a price change does not apply to an order that has already been confirmed.

4. Orders

To place an order, the customer selects the products they wish to purchase and adds them to their cart.

Before finalizing the order, the customer may review and modify the information entered.

The order is definitively confirmed when the customer confirms their purchase and proceeds with payment.

The customer is responsible for the accuracy of the information provided, including their name, delivery address, email address, and phone number.

An order confirmation is sent to the email address provided by the customer.

Kippway reserves the right to refuse or cancel an order in cases provided for by law, particularly in the event of suspected fraud, an obvious pricing error, or a problem affecting product availability.

In the event of cancellation of an order that has already been paid for, the customer will be refunded the amounts actually paid.

5. Payment

Payment is made at the time the order is placed.

Kippway accepts the payment methods offered on the store at the time of purchase.

Payments may be processed by Shopify Payments and/or other payment providers available on the store.

Kippway never asks customers to provide their password or complete bank card details by email.

The order is processed after payment confirmation.

6. Delivery

Products are delivered to the address provided by the customer when placing the order.

Delivery areas, estimated delivery times, and applicable fees are indicated on the store before the order is confirmed.

The delivery times communicated are estimates, except when a specific deadline is expressly indicated as guaranteed.

Kippway makes every effort to meet the announced delivery times.

In the event of a delivery delay, the customer may exercise the rights provided for by applicable legislation.

The customer is responsible for the accuracy of the delivery address provided when placing the order.

When a package cannot be delivered due to an incorrect or incomplete address provided by the customer, additional fees may be charged for a new shipment, where legally permitted.

7. Transfer of Risk

For consumer customers, the risk of loss or damage to the product is transferred to the customer when the customer themselves, or a third party designated by them other than the carrier proposed by Kippway, physically takes possession of the product.

This rule does not apply when the customer independently chooses a carrier other than the one proposed by Kippway.

8. Right of Withdrawal

In accordance with the legislation applicable to distance sales, consumer customers have a period of 14 days from receipt of their order to exercise their right of withdrawal.

The customer is not required to provide a reason for their decision.

The practical procedures for returns and refunds are detailed in our Return and Refund Policy, available on the Kippway store.

Direct return shipping costs are the responsibility of the customer under the conditions provided by law.

The customer remains responsible for any depreciation of the product resulting from handling beyond what is necessary to establish its nature, characteristics, and proper functioning.

9. Legal Guarantees

Products sold by Kippway are covered by the applicable legal guarantees.

Legal Guarantee of Conformity

In accordance with Articles L.217-3 and following of the French Consumer Code, the customer benefits from the legal guarantee of conformity.

For new goods, this guarantee applies for a period of two years from the delivery of the product, under the conditions provided by law.

When the legal conditions are met, the customer may request, in particular, the repair or replacement of the product.

When bringing the product into conformity is impossible or when the conditions provided by law are met, the customer may benefit from other remedies provided for by applicable legislation.

Guarantee Against Hidden Defects

The customer also benefits from the legal guarantee against hidden defects provided for under Articles 1641 and following of the French Civil Code.

These legal guarantees apply independently of any commercial guarantee that may be offered by Kippway.

10. Returns and Refunds

The conditions applicable to returns, refunds, and exchanges are detailed in our Return and Refund Policy.

This policy does not limit any of the legal rights granted to consumers.

11. Product Availability

Orders are processed subject to product availability.

In the event of exceptional unavailability of a product after the order has been confirmed, Kippway will inform the customer as soon as possible.

Where applicable legislation provides for it, the customer may request cancellation of the order and obtain a refund of the amounts paid for the unavailable product.

12. Customer Account

The customer may create an account on the Kippway store.

The customer is responsible for keeping their login credentials confidential and must promptly inform us of any unauthorized use of their account.

Kippway may suspend or delete an account in the event of fraudulent, abusive, or contrary-to-these-Terms use, subject to the customer's rights and applicable legislation.

The customer may request the deletion of their account in accordance with our Privacy Policy.

13. Intellectual Property

All elements present on the Kippway store, including texts, photographs, logos, visuals, graphics, videos, brand elements, and content, are protected by applicable intellectual property laws.

Unless prior authorization has been obtained from Kippway or otherwise provided by law, any reproduction, representation, modification, distribution, or exploitation of these elements is prohibited.

The Kippway brand and visual identity elements may not be used without authorization.

14. Liability

Kippway implements the reasonable measures necessary for the proper functioning of its online store.

However, Kippway cannot be held liable for damages resulting from an event beyond its control or a case of force majeure within the meaning of the law.

Kippway cannot, in particular, be held liable for temporary website interruptions resulting from maintenance operations, technical issues, or events reasonably beyond its control.

Nothing in these Terms limits the legal rights of consumers or Kippway's liability when such a limitation is prohibited by law.

15. Personal Data

Personal data collected in connection with orders and the use of the store is processed in accordance with our Privacy Policy.

This policy explains, in particular, the data collected, its purposes, retention periods, and customers' rights.

16. Reviews and Comments

When the store allows customers to publish reviews or comments, these must remain respectful and must not contain illegal, misleading, defamatory, hateful content, or content that infringes upon the rights of third parties.

Kippway may remove content that is clearly contrary to these rules or the law.

19. Applicable Law

These Terms are subject to French law.

When the customer is a consumer residing in another country, the mandatory provisions applicable to them under the legislation of their country of residence shall remain applicable.

20. Amendments to the Terms

Kippway may modify these Terms to take into account changes in its services, business activities, or applicable regulations.

The version applicable to an order is the version accepted by the customer at the time the order is confirmed.
