General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter the “Terms and Conditions”) govern sales made on the Kippway website.

By placing an order on the website, the customer acknowledges having read these Terms and Conditions and accepts them without reservation.

2. Products

Kippway offers clothing and fashion items for sale.

The essential characteristics of each product are presented on its product page.

Photographs and visuals are provided for illustrative purposes. Kippway strives to represent the products as accurately as possible.

Products are offered subject to availability.

In the event that a product becomes unavailable after an order has been validated, the customer will be informed and may receive a refund for the product concerned.

3. Prices

Product prices are indicated on the website at the time of the order.

The applicable prices are those displayed at the time the order is validated.

Any applicable delivery costs are indicated to the customer before the final validation of the order.

For international orders, customs duties, import taxes or customs clearance fees may be applied depending on the destination country. When they are not included in the price paid at the time of the order, these costs are borne by the customer.

Kippway reserves the right to modify its prices at any time. A price change does not apply to orders that have already been validated.

4. Order

The customer selects the products they wish to purchase and adds them to their cart.

Before confirming their order, the customer may review and modify the information entered.

The order is definitively validated after payment has been confirmed.

A confirmation email is sent to the address provided by the customer.

Kippway reserves the right to refuse or cancel an order in the event of suspected fraud, an obvious error concerning the price or product, or a payment issue.

5. Payment

Payment is made online using the payment methods offered on the website.

Kippway notably uses Shopify Payments to process payments.

The banking information required for payment is processed by the relevant payment service providers and is not stored by Kippway in the form of complete bank card data.

The order is considered validated after payment has been confirmed.

6. Delivery

Kippway ships orders within France and internationally.

Orders are generally prepared and handed over to the carrier within 1 to 2 business days after validation.

Delivery times vary depending on the destination, carrier and any applicable customs procedures.

Applicable delivery costs are indicated before the order is validated.

When the delivery service allows it, a tracking number is provided to the customer.

The customer is responsible for the accuracy of the delivery address provided when placing the order.

Detailed delivery terms are specified in Kippway’s Shipping Policy.

7. Right of Withdrawal

In accordance with the regulations applicable to distance sales, consumer customers have a period of 14 calendar days from receipt of their order to exercise their right of withdrawal, without having to provide any justification.

After informing Kippway of their decision to withdraw, the customer has an additional period of 14 days to return the product.

The customer may try on a garment in order to check its size, fit or characteristics, as they could do in a store.

However, the product must be returned in a condition that allows its characteristics and functioning to be assessed. The customer may be held liable for any depreciation resulting from handling beyond what is necessary to verify the product.

Products must not, in particular, have been washed, damaged or excessively used.

The customer bears the direct return costs when exercising their right of withdrawal, unless otherwise provided by law.

The refund includes the price of the product as well as the initial standard delivery costs. Additional costs corresponding to a more expensive delivery method chosen by the customer are not refunded.

The refund is made under the conditions provided for by the applicable regulations and, in principle, using the same payment method as the one used for the order.

Kippway may defer the refund until the product has been recovered or until proof of shipment of the returned product has been received.

8. Returns and Refunds

Kippway does not automatically provide product exchanges. When a customer wishes to change the size or model, they may return the product in accordance with the applicable conditions and place a new order, subject to availability.

Discounted products or products subject to a promotion benefit from the same legal rights applicable to other products.

Detailed procedures are specified in the Return and Refund Policy.

9. Legal Guarantees

Products sold by Kippway are covered by the applicable legal guarantees, including:

• the legal guarantee of conformity;

• the legal guarantee against hidden defects.

The customer may exercise their rights under these guarantees free of charge under the conditions provided by law.

In the event of a defective or non-conforming product, the customer must contact Kippway at opoukouecom@gmail.com, indicating their order number and, where useful, providing photographs of the product concerned.

These legal guarantees apply independently of any potential commercial warranty.

10. Customer Account

The customer may create a personal account on the website.

The customer is responsible for the accuracy of the information provided and for keeping their login credentials confidential.

The customer may request the deletion of their account under the conditions provided by the applicable regulations.

Creating an account is not necessarily required to place an order when this option is offered on the website.

11. Personal Data

Personal data collected when using the website and placing an order is processed in accordance with Kippway’s Privacy Policy.

The customer has, in particular, rights of access, rectification, erasure, restriction, objection and portability under the conditions provided by the applicable regulations.

12. Intellectual Property

All elements present on the Kippway website, including texts, photographs, images, logos, videos, graphics and visual elements, are protected by applicable intellectual property laws.

Any unauthorized reproduction, use, modification or exploitation of these elements is prohibited.

13. Liability

Kippway shall not be held liable for damages resulting from improper use of the products by the customer.

Kippway shall also not be held liable for temporary interruptions of the website or events beyond its control, subject to the legal obligations applicable to it.

Nothing in these Terms and Conditions limits the legal rights granted to consumers.

14. Force Majeure

Kippway shall not be held liable for any delay or failure to perform resulting from an event reasonably beyond its control, including in the event of a natural disaster, strike, conflict, major breakdown, transportation issue or other force majeure event recognized by law.

15. Consumer Mediation

In accordance with applicable regulations, consumers may, after having first submitted a written complaint to Kippway and in the absence of a satisfactory resolution, have free access to a competent consumer mediator.

The contact details of the competent mediator will be indicated as soon as they are officially appointed by Kippway.

16. Disputes and Applicable Law

These Terms and Conditions are governed by French law, subject to mandatory provisions applicable to consumers residing in another country.

In the event of a dispute, the customer is invited to contact Kippway first in order to seek an amicable solution.

In the absence of an amicable agreement, the dispute may be submitted to the competent courts in accordance with the applicable legal rules.

17. Amendments to the Terms and Conditions

Kippway reserves the right to modify these Terms and Conditions at any time.

The Terms and Conditions applicable to an order are those accepted by the customer at the time the order is validated.
